Terms & Conditions
Last updated: 6 October 2026
These Terms govern your use of www.kheratilall.com (the "Website") and any commission placed with Kherati Lall Sons Private Limited ("Kherati Lall", "we", "us"), 80 Janpath, New Delhi 110001 (CIN: U74899DL1987PTC027324). By using the Website or placing a commission, you agree to these Terms.
1. Use of the Website
The Website presents our work and invites enquiries. It is not an online shop, and nothing on it is an offer for sale. You agree to use it lawfully, not to interfere with its operation, and not to copy, scrape or reproduce its content for commercial use.
2. Our work and its nature
Every piece we make is cut, polished and assembled by hand. Small variations in dimension, cut, colour, finish and the patina of brass are inherent to handmade work and are not defects. This does not extend to defects in workmanship or a material departure from the approved drawings and specification. Photographs and descriptions on the Website are representative; screen colours and lighting may differ from the finished piece.
3. Enquiries, quotations and commissions
Enquiries made through the Website are invitations to discuss a commission and are not binding on either party.
Quotations are valid for 30 days from issue unless stated otherwise, and are subject to change if the specification, quantity or site conditions change.
A commission is confirmed only when you accept our written quotation or proforma invoice and advance payment is received.
Bespoke pieces are made to the drawings, dimensions and finishes you approve in writing. Changes after approval may impact price and delivery time.
4. Prices and payment
Prices are quoted in Indian Rupees, or in the currency stated in the quotation, and are exclusive of GST, packing, freight, insurance and installation unless stated otherwise.
An advance, as stated in the quotation or proforma invoice, is payable to confirm a commission. The balance is payable within 7 days of our notice that the piece is ready for dispatch, and in any event before dispatch, unless agreed otherwise in writing.
Ownership of a piece passes to you only on receipt of full payment.
Payments are accepted by bank transfer, UPI, card payment, or cheque to the account named on our invoice. We never ask for payment details through the Website or social media messages.
5. Production and delivery
Production timelines are estimates given in good faith, and run from confirmation of the commission and approval of final drawings. We will notify you when your piece is ready for dispatch. If delivery is deferred at your request for more than 30 days after that notice, storage is charged at 1% of the order value per week, up to a maximum of 10% of the order value, payable before dispatch, and the piece is held at your risk from that point.
We are not liable for delays caused by events beyond our reasonable control, including natural disasters, strikes, transport disruption or government action.
We are responsible for door-to-door delivery. Except during a deferred-delivery period described above, the piece remains at our risk, including in transit, until it is delivered to the agreed address. Please inspect pieces on delivery and report any visible transit damage, with photographs, within 48 hours. Defects that could not reasonably be seen on delivery remain covered by the warranty in Section 8.
International shipments are made on the terms stated in the quotation. Import duties, taxes and customs clearance in the destination country are the client's responsibility unless agreed otherwise.
6. Installation
6.1. Installation requires site readiness, a suitable ceiling or wall structure, working electrical points, and access (including appropriate scaffolding) as advised by us. Additional visits caused by an unprepared site may be charged.
6.2 Exclusions from Scope of work: Electrical connection to the mains must be carried out by a licensed electrician and fall outside our scope of work. Hook installation and similar civil work does not form part of our scope of work.
7. Cancellations and returns
Commissions cannot be cancelled once production has begun. Production begins on your approval. Refunds will not be entertained for made to order commissions.
Where a piece is defective or non-conforming, we will, at our option, repair, replace or refund the affected part.
8. Warranty and care
We warrant our pieces against defects in workmanship for 12 months from delivery. The warranty does not cover breakage after delivery, normal wear, the natural patination of brass, damage from improper cleaning, installation or alteration by others, or bulbs and electrical consumables. Care guidance is provided with every piece.
9. Intellectual property
All designs, drawings, photographs, text, logos and other content on the Website and in our proposals belong to Kherati Lall Sons Private Limited or are used with permission. Unless expressly agreed otherwise in writing, all designs and drawings we prepare, including those made for a specific commission, remain our property. Designs and drawings supplied by a client remain that client's property. A commission transfers ownership of the finished piece, not of its design, and our drawings may not be used to have the piece made elsewhere. The names Kherati Lall and Kherati Lall & Sons may not be used without our written consent.
10. Limitation of liability
To the extent permitted by law, our total liability in connection with any commission is limited to the price paid for the piece concerned. We are not liable for indirect or consequential losses, or for any loss arising from use of the Website or reliance on its content. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud or wilful misconduct, or any liability that cannot be limited under applicable law, including your rights under the Consumer Protection Act, 2019.
11. Privacy
Our use of your personal data is described in our Privacy Policy.
12. Governing law and disputes
These Terms are governed by the laws of India. Any dispute will first be addressed through good-faith discussion. If unresolved within 30 days, it will be subject to the exclusive jurisdiction of the courts at New Delhi.
13. Precedence and changes
We may revise these Terms from time to time. The version in force when your commission is confirmed applies to that commission. Where these Terms conflict with a quotation, proforma invoice or agreement accepted in writing for a commission, that document prevails for that commission.
